Acceptance of Agreement
These Terms & Conditions (“Agreement”) govern your relationship with Real Wealth In USA (“Real Wealth,” “we,” “us,” or “our”) for the use of our website (realwealthinusa.com) and any services we provide, including but not limited to property leasing, short-term rental management, investment opportunities, and professional buyer/seller services.
By contacting us, listing a property with us, signing a property-management agreement, or otherwise using our services or website, you accept and agree to be bound by this Agreement.
This Agreement, together with any executed Owner/Management Agreement, constitutes the entire agreement between you and Real Wealth regarding the subject property and supersedes prior communications. Signing the Owner/Management Agreement, listing your property, or allowing us to operate your property constitutes acceptance of these Terms & Conditions
Services Provided
We provide property partnership and management services designed to increase owners’ monthly cashflow.
Services may include property assessment and qualification, leasing (including filling vacant units), tenant screening, guest or tenant management, marketing, day-to-day maintenance coordination, and revenue collection and distribution.
We also offer related real estate services such as buy/sell assistance, investment opportunities (e.g., short-term rental investments, REITs), and market analysis. The exact scope of services, fees (if any), and performance commitments will be described in the separate Owner/Management Agreement you sign with us.
Owner Representations & Eligibility
By entering into an Owner/Management Agreement you represent and warrant that:
- You are the legal owner or authorized agent with authority to enter into the agreement for the property;
- The property is in compliance with all applicable local, state, and federal laws and codes;
- Any information you provide about the property (title, occupancy, mortgage encumbrances, condition, utilities, insurance) is accurate and up to date; and
- You will notify us promptly of any change affecting the property’s legal status or insurability.
Payment, Rent Distribution & Guarantees
a. Rental Payments & Distribution. Any rent or guaranteed payment terms will be set out in the Owner/Management Agreement. We will collect rents and other revenues and distribute owner proceeds according to the schedule and method described in that agreement.
b. Guaranteed Rent Claims. Where a “guaranteed rent” or similar guarantee is offered, the terms, duration, and conditions of that guarantee are detailed in the executed Agreement and any applicable addenda. Guarantees are contractual obligations and apply only as expressly stated. (The Investing page describes our model for increasing owner cashflow and performing full management; specific guarantee language appears in your signed agreement.)
c. Taxes & Utilities. Owners remain responsible for property taxes, any mortgage payments, homeowner association dues, and utility charges unless otherwise stated in the Owner/Management Agreement. We do not assume responsibility for unpaid taxes or liens.
Indemnification
Owners agree to indemnify and hold Real Wealth harmless from claims arising out of Owner’s breach of representations or failure to maintain required insurance, except to the extent caused by our gross negligence or willful misconduct. Real Wealth will indemnify Owners for direct damages arising from our gross negligence or willful misconduct as set forth in the Owner/Management Agreement.
